Terms and conditions of sale

Article 1 — Purpose and scope

These terms and conditions of sale govern distance sales concluded through the website alicepeintures.com between the Seller and any consumer (the "Customer"). They apply to the exclusion of any other terms. Placing an order implies the Customer's full and unreserved acceptance of these terms in the version in force on the date of the order.

Article 3 — Works offered

The website offers original, unique works (paintings by the artist Alice Voland). Each work exists in a single copy: it is sold only once and becomes unavailable as soon as an order covering it is paid. Photographs and descriptions are indicative; slight variations in tone may occur owing to screen rendering. Availability is shown in real time on each work's page.

Article 4 — Prices

Prices are shown in euros (EUR), all taxes included. Under the VAT franchise en base regime, no VAT is charged.

TVA non applicable, article 293 B du CGI.

The price shown on a work's page is the price of the work; delivery costs are added at payment (see Article 6). The Seller may change prices at any time, it being understood that a work is invoiced at the price in force when the order is validated.

Article 5 — Ordering and payment

  1. the Customer adds one or more works to the basket;
  2. the Customer enters an email address and receives a single-use verification code, which must be entered to confirm control of that address (no account and no password are created);
  3. the Customer enters the delivery address, whose country determines the delivery charge added to the order;
  4. the Customer is redirected to the secure payment page hosted by Stripe, where payment details are provided;
  5. once payment is accepted, the order is confirmed by email and the work is withdrawn from sale.

Payment is made exclusively by bank card through Stripe, the payment services provider. Card details are entered directly in Stripe's secure environment; they never pass through alicepeintures.com and are never stored there. The order is definitively formed only on effective payment of the price and delivery costs. Where the same unique work is sold concurrently, the order whose payment did not complete is cancelled and refunded in full where applicable.

Article 6 — Delivery

Works are shipped to mainland France and to the continental European Union. The Seller does not ship outside that area — in particular not to the French overseas departments and collectivities, the Canary Islands, Ceuta, Melilla, the Azores, Madeira or Åland, nor outside the European Union.

Delivery costs are a flat rate per order, whatever the number of works:

  • mainland France: 10 €;
  • continental European Union: 20 €.

The delivery address is entered before payment and determines which rate applies. Delivery times are indicated when ordering and run from confirmation of payment. Risk transfers to the Customer on physical delivery of the work to the Customer or to a third party designated by the Customer.

Article 7 — Right of withdrawal

The Customer has fourteen (14) days to exercise the right of withdrawal from a distance contract, without having to give a reason, running from the day after the Customer (or a third party designated by the Customer) takes physical possession of the work.

This right applies in full to the works sold here. They are pre-existing, unique, non-personalised works: they are not made to a buyer's specifications, and the uniqueness of a work is not a personalisation within the meaning of the law.

How to withdraw online

An online withdrawal functionality is available free of charge on your order page, under the heading "Droit de rétractation", by means of a control labelled « renoncer au contrat ici ». It is available throughout the withdrawal period.

To reach your order page at any time, request a fresh link from the order lookup page using the email address you ordered with — no account is needed. You will receive an acknowledgment of receipt of your withdrawal on a durable medium, stating its content and the date and time it was sent.

You may also notify your decision by email to alice@alicepeintures.com, or by using the model withdrawal form reproduced at the end of these terms. Any unambiguous statement of your decision is sufficient; returning a work without any declaration is not.

Article 8 — Return and refund

Following withdrawal, the Customer returns the work without undue delay and at the latest within 14 days of notifying the decision.

Return costs

The direct cost of returning the work is borne by the Customer.

As an indication, per work, returned by insured post:

  • from mainland France: up to approximately 15 €;
  • from another continental European Union country: up to approximately 25 €.

Where several works are returned together, the actual cost is generally well below the sum of these amounts, since postage does not double with a second work. These are maximum estimates; you pay the carrier directly and may use any carrier you wish.

Given the fragility and value of the works, the Customer undertakes to return the work in its original packaging and with insured carriage. The Customer may be liable for any depreciation resulting from handling beyond what is necessary to establish the nature and characteristics of the work.

Refund

The Seller refunds all sums paid, including the original delivery costs, at the latest 14 days after being informed of the withdrawal, using the same payment method used for the original transaction, through Stripe.

The refund may be deferred until the work has been recovered or until the Customer provides proof of its dispatch, whichever occurs first.

Article 9 — Legal guarantees

The Customer benefits from the legal guarantee of conformity and the guarantee against hidden defects under the conditions provided by law. These guarantees apply independently of the right of withdrawal.

Article 10 — Disputes

These terms are governed by French law. In the event of a dispute, the Customer should first contact the Seller to seek an amicable solution.

Consumer mediation

Under article L.612-1 of the French consumer code, you are entitled to use a consumer mediator free of charge to seek an amicable resolution of any dispute with us.

A case may be referred to the mediator only after a written complaint has been sent to us and has not received a satisfactory response, and within one year of that complaint.

Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract. Using it is optional — the online functionality described in Article 7 has the same effect.
